Abstract
Psychological Harassment at Work (Mobbing) means the employer’s or the other worker’s causing someone to be psychologically damaged at work in scope of intentional and constant psychological attacks. Thus, such a process can be evaluated as very harmful to both the productivity of the organization and the country’s economy because of breaking up the peaceful working atmosphere at work even causing the employee to leave the job since his/her personal productivity and effectiveness decreased due to such unjust treatment that has damaged to his/her physical, social and mental completeness accordingly.Since mobbing is rather an important issue from the point of view of the employees and the organization, it has led some legal measures to be taken to prevent such a harmful effect. However, it is seen that this concept does not take part in our enforceable regulations directly, although, today in many developed country, the legal measures had been taken to prevent the mobbing at work and to eliminate the personal and organizational injuries caused by this concept at work in scope of researches held to identify and remove the consequential results. Additionally, it is seen that some efforts are being spent to enable the mobbing concept to be involved in the Draft Act Proposal for the New Version of the Law of Debts in order to get this concept involved in Turkish Law Regulation by considering the psychological and organizational effects of mobbing at work. In this study, the place of mobbing was reviewed in the Turkish Law Regulation within the frame of conceptual structure and content of mobbing.
