Abstract :
A major stumbling block to designing a good contract is a legal concept called meeting of the minds. The basis for this concept is that two parties cannot agree unless they understand what they are contracting for. The process of drawing up a written contract is intended to assist in this understanding. However, much room remains for error when negotiating something as technical as software development.
