According to the current law, transportation is divided into operational and non-operational transportation. However, there are shortcomings in the explanation which results in lots of contradicts between road transport supervising organization and operator and negatively affects operating environment. Based on the analysis of the existing legal provisions, this paper will explain in details the existing social problems and categorize the transportation behavior according to economic characteristic, theory and international experience in the hope of resolving social contradicts and problems.
