    This paper discusses the institutional framework to disaster management in China. Because disaster never happened obey the boundary of manmade, so we view this framework in an angle of inter-governmental relationships. The central government plays a leading role in this framework while the local governments play passive role. There is no communication mechanism between local governments except the coordination from the central government. This is an efficient system design. However in the same time the weaknesses of this system are also evident for example the lack of initiative of local governments, the high cost of information transmit and etc. Based on these analyses this paper suggests that we should construct a disaster management framework which based on law and would have a communion of interests between all the governments.
