Abstract :
The designers, producers and disseminator of E-government information resource database should bear the liability to damages to the victims (users), if they provide the defective database and causes damage to others. Based on database user rights protection and promoting the development of science and culture, database product liability shall apply the principle of presumptive fault, the constituents of which include the defective database, damage facts and causality between defective database and damage facts. Exemptions of database product liability include the case in which database has not been put into circulation, the case in which defects do not exist when database is put into circulation or they are beyond the human knowledge level, the victim´s fault and using expired database.
