An analysis of control measures concerning Vessel-sourced pollution in the Taiwan Strait area under the UNCLOS

Abstract :
Control measures against Vessel-sourced pollution should focus on strengthening management of navigation in the Strait. Firstly, according to the UNCLOS, the Strait isn´t a strait used for international navigation and should not apply to transit passage. Penghu waterway may be delimited inland waters, and navigation of foreign vessels can be limited to effectively prevent pollution from vessels. Secondly, based on the special geography and shipping situations of the Strait, PSSA may be established in accordance with standards and procedures of IMO, and some measures, including the prohibition of navigation in specific areas or of vessels of specific types, may be taken in the Strait. Finally, through the implementation of TSS to regulate the sailing of vessels, maritime casualties can be avoided to protect environment of the Strait to the greatest extent.
