Arbitration and adjudication are processes whereby an independent third party reaches an evaluative decision which is capable of being imposed upon the parties to the contract. In ADR (alternative dispute resolution), however, it is the parties themselves who are the authors of the settlement agreement. The author discusses the main points of each process
