Facing increasingly intense environment of technology competition, innovation joint venture is an effective way to keep and promote enterprise competitive capability. Due to the different technology strength of parties, and there are a certain market competitive relationship within partners. Therefore, how to enhance intellectual properly protection while receiving technology from cooperation is a key issue of gaining maximum benefit of each party. This issue depends on intellectual property protection mechanisms (IPPMs). In this paper, effects of IPPMs are discussed in the formation of joint venture according to different industries , forms of joint venture and firms scales. Patents are mostly frequently used IPPM to protect both foreground and background during the cooperation. Trade secretes are widely employed while protecting tacit knowledge and know-how technology. Intellectual property facilitates a new joint venture in the early negotiating stage. IPPMs within the competitive joint venture and supply-demand joint venture are becoming more complex.
