  • Abstract
    The electronic contract is greatly different with traditional contract, which triggers a lot of new legal issues. Based on Chinese legislative practice, this article analyzes the main issues in electronic contracts, including: the client capacity, the offer and acceptance in the electronic contract formation process, the establishment time and place of electronic contracts, the electronic signatures, the evidential weight of electronic contracts, and the conflicts of jurisdiction. In the end, the author come to a conclusion that China must establish a set of electronic contract rules linked to the international practices to adapt to e-commerce development.
