Abstract :
The First part points out the study of legal aspects of electronic contract in developed countries like Europe, Australia, U.S.A., U.K. Japan & India. The object of this research paper is that Today´s generation is computerized. Need of study on international convention. Millions of people used electronic contract for commercial purpose resulted into increased world economy. The comparative study of it outlines the importance of e-commerce in new area of computerized sector. The final part addresses the difficulties that might arise while implemented the act with comparative study of legal provision of e-contract & digital signature in cyberspace, offence preventive steps. There is Lack of adequate training of law enforcement in the area of security of cyber & E commerce; Use of an electronic contract in the conduct of day to day business worldwide continues to grow. With this growth comes the need for guidelines for electronic contract education and certification of the validity of electronic transactions. As per observation we come across lack provision in formation of e-contract, Information Technology Act, Cyber law, Indian contract Act, Indian Evidence Act not wholly justified to electronic contract. Then it´s very difficult to define or justified validity of electronic contract. Therefore we come across these e-contracts in various developed countries but are unaware of the legal formation challenges connected to it.
