Abstract :
The case involved saw blades for use in orthopedic surgery. Brasseler, a Georgia company, had an idea for an improved blade with a double row of cutting teeth. Brasseler contracted with DS Manufacturing, a California company to develop the blade. The companies worked together on the blade and, once it was completed, Brasseler ordered 3,000 units from DS and began selling the blades to hospitals. Accordingly, the court held that the blades that had been sold were precisely those that had been claimed in Brasseler´s patent and thus their sale by DS started the one-year clock
