بررسي آثار مجازات منع اشتغال دريك نقطه يا نقاط معين در تكرار و جابجايي جرم (مورد مطالعه: قرارگاه منطقه جنوب غرب نزاجا)

تكرار جرم، ازجمله دقيق ترين و سخت ترين مباحث حقوق كيفري است. از آن جهت كه با مسائل جزايي و اجتماعي مرتبط است و اينكه اجراي عدالت، مرتبط با آن مشكلات متعددي را براي دادگاه ها ايجاد كرده است. منظور از جابجايي جرم امري است كه سبب تغيير عمل مجرمانه در زمان، مكان، شيوه ي ارتكاب و نوع جرم ارتكابي مي شود؛ درجابجايي ممكن است مجرم بالقوه به دنبال فرصت مناسب ديگر براي ارتكاب همان جرم يا جرم ديگري باشد. براين اساس هدف پژوهش پاسخگويي به اين سوال است كه ببيند آيا جابجايي نظاميان بزهكار به يگان هاي جديد مي تواند موجب تكرار و جابجايي جرم گردد. روش مورد استفاده در اين پژوهش روش پيمايشي با استفاده از پرسشنامه بوده و جزء تحقيقات كاربردي محسوب مي گردد. حجم نمونه در اين پژوهش با استفاده از فرمول نمونه گيري كوكران و در نظر گرفتن مصالح حفاظتي و امنيتي، برابر با 40 نفر محاسبه شده است. ابزار گردآوري داده ها يك پرسشنامه محقق ساخته مي باشد. پايايي پرسشنامه به روش آلفاي كرونباخ در حوزه جابجايي جرم (0/76) تائيد گرديده است. تجزيه تحليل داده ها بر اساس ماهيت داده ها و شيوه ي بيان فرضيات در قالب آزمون تي تك نمونه اي و با نرم افزار آماري 24 SPSS انجام شده است. با توجه به يافته هاي پژوهش با مجازات منع اشتغال در يك نقطه يا نقاط معين، تكرار و جابجايي جرم در قرارگاه منطقه جنوب غرب نزاجا صورت گرفته است.

The repetition of crime is one of the most precise and difficult issues of criminal law matters; because it is related to criminal and social issues and the implementation of its related justice has created numerous problems for the courts. The displacement of crime is something that causes the criminal act to change in time, place, manner of committing, and type of crime. The purpose of the study is to see if the displacement of criminal militias into new units could lead to the repetition and displacement of crime? The sample size in this study is based on the Cochran sampling formula, which is equal to 40 people due to the protective and security components. Data collection tools were a researcher-made questionnaire. The reliability of this questionnaire was confirmed by Cronbach's alpha test in the field of transfer of a crime (0/76). Data analysis was performed based on the nature of the data and the way of expressing the hypotheses in a single-sample t-test with SPSS 24 software. According to the findings of the study, with the Punishment of employment ban on the employment of a particular job(s) in the repetition and transfer of a crime, the repetition and transfer of crime occurred in the units of Headquarters of the Southwest Army.
