در اين مقاله، در ارتباط با برخي موانع و چالش ­هاي اجرايي شدن قانون اجراي اصل 44 قانون اساسي در شركت ملي پالايش و پخش فرآورده ­هاي نفتي ايران به تحليل رئوس اين ابهامات، تشتت­ ها و چالش ها پرداخته مي­ شود. در بررسي تحليلي اين موضوع، چند مقوله بيش از سايرين به ذهن متبادر مي­ گردد كه از اين قرار است: ابهام در مباني و اصول و قواعد، چالش در خدمت عمومي، تضاد واگذاري­ ها با نوع دولت مفروض قانون اساسي، سردرگمي در نهاد مالكيت شركت هاي واگذار شده، ابهام در خصوص كارمندان شاغل درشركت هاي واگذار شده، چالش در وضعيت بازنشستگي و ابهام در ميزان امتيازات و قواعد حاكميتي شركت­ ها.هر كدام از اين موضوعات را جداگانه به بحث تحليلي گذاشته و در حد گنجايش تحقيق به ذكر نمونه­ ها، آثار و عواقب و نحوه عملكرد نهادهاي مربوطه در راستاي حل و رفع آن­ها به استناد مستندات و مصوبات پرداخته مي­ شود.
