Critique of the "Criminal Policy in Islam and in the Islamic Republic of Ir@n"

اصولاً هر رشته مطالعاتي به گونه اي انتخاب شده و برگزيده مي‌ شود كه از يك سو بيانگر محتواي آن رشته باشد و از سوي ديگر، بتواند حدود و قلمرو آن را تبيين نمايد مانند جامعه شناسي، كيفرشناسي، جرم شناسي و غيره. حال آنكه سياست جنايي رشته‌ اي است كه هم از گسترده فراتر از عنوان خود برخوردار است و شامل موضوعات متعدد و گوناگون مي‌ باشد و هم آنكه از نگاه عرصه هاي متنوع علمي و نيز نظام هاي مختلف حقوقي بويژه ديني و اسلامي، قابليت طرح ارزيابي دارد. درباره مفهوم سياست جنايي از گذشته تاكنون، نقطه نظرات انديشمندان بسياري در جوامع غربي و شرقي و نيز در ايران قبل و پس از انقلاب اسلامي بيان شده است كه در مواردي از آنها، نيازمند تامل و دقت است. پرداختن به نگاه غيرديني و ديني به سياست جنايي و ترسيم جايگه آن در اين دو قلمر، موضوعي است كه در كتاب مورد ارزيابي، بدان توجه شده است و نگارنده تلاش نموده اند تا جايگاه را تبيين نمايند و از نقش آن در مباحث ديني و به تبع آن، در نظام حقوقي كنوني جمهوري اسلامي ايران سخن بگويند.

Basically, each discipline is selected and chosen to indicate the content of the field on the one hand, and on the other hand, it can explain its scope, such as sociology, rhetoric, criminology, and so on. While a criminal policy is a discipline that extends far beyond its title and includes many different subjects, it is also capable of evaluating from a diverse range of scientific disciplines, as well as various legal systems, especially religious and Islamic. About the concept of criminal policy from the past, the views of many writers in Western and Eastern societies, as well as in Iran before and after the Islamic Revolution, have been expressed, which in some cases require careful consideration. Addressing the secular and religious viewpoint of the criminal policy and plotting its place in these two groups: the first group is a subject that has been considered in the book of evaluation, and the author has attempted to explain the position and its role in religious matters and consequently it is in the current legal system of the Islamic Republic of Iran.
