The Role of Ethics in Explanation and Implementation of the Rules of Humanitarian Law with Emphasis on Islamic Doctrines

بررسي آموزه هاي اسلامي نشانگر نقش اثرگذار اخلاق در پايه گذاري قواعد حقوقي در گام نخست و اجراي آنها در گام بعدي است. اين نقش، به ويژه در مورد بسياري از قواعد حقوقي اي كه براي طرفين درگيري در جريان منازعات مسلحانه تدوين گرديده، برجسته است. بي ترديد در حقوق بشردوستانه قواعدي وجود دارد كه جز به وسيله اصول اخلاقياي كه مبناي آنها قرار گرفته، توجيه پذير نخواهد بود، از اين رو بررسي نقش اين اصول اخلاقي در تبيين و اجراي قواعد حقوق بشردوستانه ضروري مينمايد. اين نوشتار در پي آن است كه پس از بررسي رابطه اخلاق و حقوق_ به صورت كلي_، به بررسي ارتباط پاره اي از آموزه هاي اخلاقي اسلام با قواعد حقوق بشردوستانه و نقش آنها در اجراي قواعد ياد شده بپردازد.

Study of Islamic doctrines depicts the effective role of ethics in foundation of legal rules in the first step and their implementation in the second. This role is especially outstanding about the legal rules that have been devised for the two parties involved in armed conflicts. Undoubtedly، there are certain rules in humanitarian law that are not justifiable except through ethical principles underlying them. Thus، studying the role of these ethical principles seems essential in explanation and implementation of the rules of humanitarian law. Upon examining the relation between ethics and law in general، this paper is intended to study the relation of some of the ethical doctrines of Islam to the rules of humanitarian law and their role in implementation of the above-mentioned rules.
