Xenotransplantation from the Perspective of Medical Jurisprudence and Law Viewpoints

پيشرفت روزافزون علم پزشكي، افق‌هاي جديدي را فراروي بشر قرار داده و اعمال شيوه‌هاي نوين را در درمان افراد امكان‌پذير كرده است. يكي از مسائل نوظهور در عرصه پزشكي، امكان پيوند عضو حيوان به انسان است كه با توجه به كمبود اعضاي پيوندي، مي‌تواند گره‌گشاي بسياري از مشكلات باشد. پژوهش حاضر با اتخاذ شيوه توصيفي- تحليلي و به روش مسأله‌محور، به بررسي اين موضوع از منظر علم پزشكي و فقه پزشكي پرداخته و با تحليل و نقد مشكلات پيش ‌رو، به اين نتيجه رسيده است كه چنين راهكاري در درمان افراد بلااشكال است. نتايج مطالعات نشان مي‌دهد علم پزشكي توانسته‌ است با كشف برخي داروها و پژوهش‌هاي متعدد، تا حد زيادي مشكلات اين نوع پيوند را رفع كند. از منظر فقهي رجوع به مفاد قاعده « لاضرر و لاحرج» و توجه به مدلول قاعده ضرورت و برخي ديگر از ادله و مستندات فقهي، صدور جواز چنين عملي امكان‌پذير است. گفتني است چنين پيوندي از منظر حقوقي و اخلاقي نيز بلااشكال مي‌باشد.

Ever-increasing progress in the development of medical sciences has provided new insights into the treatment methods. Xenotransplantation is one of these novel methods, which could be a solution for numerous problems caused by the shortage of organs donation. This descriptive-analytical study sought to assess this issue from the perspective of jurisprudence and law viewpoints. After assessing foregoing issues, we concluded that such treatment is permitted. According to the literature, the problems of this type of transplantation have been resolved by discovering new medicines and performing numerous studies. From the perspective of jurisprudence, considering the principles of lā ḍarar (no harm) and ḍarūrat (necessities render the prohibited acts permissible), this modality of treatment is permitted. It is worth mentioning that xenotransplantation is allowed regarding the legal and ethical obligations.
