تغييرات آب و هوايي: تاملي بر راهبردها و تدابير حقوقي سازمان ملل متحد

CLIMATE CHANGES: A REFLECTION ON THE U.N. LEGAL POLICIES and MEASURES

امروزه تغيير آب و هوايي جزء مسايل و نگراني هاي قابل توجه جامعه بين المللي به شمار مي رود. سازمان ملل متحد از سال 1979 اين مساله را شناسايي كرده و با برگزاري دهها كنفرانس بين المللي و منطقه اي و تصويب دو سند الزام آور بين المللي به تدريج سياست ها، خط مشي ها و تدابير حقوقي را براي رويارويي با تغييرات ياد شده توسعه داده است. تثبيت و كاهش گازهاي گلخانه اي و سازگاري با تغييرات آب و هوايي سه خط مشي ملل متحد در اين باره به شمار مي روند. كنوانسيون ساختاري براي خط مشي تثبيت و سازگاري و پروتكل كيوتو براي كاهش گازهاي گلخانه اي تدابير حقوقي رو به تكاملي ارائه مي دهند. تصويب اين اسناد بخشي قابل توجه از فقر هنجاري در رويارويي با مساله تغييرات آب و هوايي را برطرف كرده است.

Nowadays the climate change is one of the main concerns of International Community. This problem, since 1979, has been addressed by the United Nations. Through the several international and regional conferences the UN has progressively developed the policies and measures to face the mentioned changes. The stabilization and reduction of the emission of greenhouse gas, and the adaptation to climate change are three policies of the UN in this regard. In this regard, UN Framework Convention on Climate Change and Kyoto Protocol are presenting some legal measures for stabilization and reduction of the emission of greenhouse gas. International Community, through adoption of these Documents, has filled the normative gap in this area and could produce considerable solidarity for facing this crisis. However, the concerns regarding implementation of the mentioned international norms are remained.
