ازجمله مسائل نوظهور فقهي، بحث تعيين جنسيّت جنين توسط تكنيك (PGD)است، در تكنيك مزبور كه تحت نظارت متخصصين انجام مي پذيرد، براي زوجين اين امكان فراهم گرديده ­است تا صاحب فرزندي با جنسيّت و ويژگي خاص شوند، گرچه استفاده از تكنيك مذكور محدود به تعيين جنسيّت نمي شود، لكن بهره گيري از آن چه با دلايل پزشكي و چه با دلايل غير پزشكي به علت بروز محذوريت هاي متعددي چون اتلاف رويانها و وقوع پيامدهاي منفي چون تبعيض جنسيّت، سوالات عديده ­اي­ را فرا روي فقه نهاده است از جمله: آيا تكنيك مذكور مطلقاً حرام است؟ آيا هر شخصي مي تواند از اين تكنيك بهره ببرد؟ آيا امثال اين تكنيك ها با علم خداوند و مشيّتش سازگار است؟ آيا استفاده از اين تكنيك، يك شيوه درماني است و به دليل نابودي رويانها مخالف با كرامت انسان نيست؟..........؛ لذا در اين مقاله ضمن واكاوي سؤالات فوق، با اتكا به ادله اثبات نموده ايم كه تعيين جنسيّت مطلقاً محكوم به حرمت نيست كه انجام آن با دلايل پزشكي و در شرايط ضروري مجاز است.
