جامعه بين المللي مفهومي پويا است كه همواره در سطح نظام بين الملل تحول و قبض و بسط پيدا مي كند. مفهوم جامعه بين المللي در عرصه ي نظري و فكري از رويكرد «كانتي» تا «ونتي» در روابط بين الملل و حقوق بين الملل تغييراتي بنيادين داشته است. در حال حاضر به واسطه دسترسي راحت و سريع به اطلاعات و گسترش ارتباطات و حذف تدريجي مرزهاي فكري و جغرافيايي، ضرورت درك دقيق تر مفهوم جامعه بين المللي اهميت مضاعف پيدا مي كند. اين امر به دليل ايجاد آثار جديد حقوقي و بين المللي، كاربرد جديدي در عرصه جهاني و تعامل ميان دولتها و سازمانها پيدا مي كند. چگونگي تحول مفهوم جامعه بين المللي و آثار مترتب آن بر روابط و حقوق بين الملل، سؤال اصلي اين مقاله مي باشد كه با در نظر گرفتن رهيافت سازه انگارانه و مطالعه موردي رويه قضايي موجود در حقوق بين الملل به عنوان روش به اين مسأله پرداخته مي شود.
