گزاره كلامي تأثيرگذار در اجتهاد (جامعيّت شريعت)

بعضي از گزاره‌هاي كلامي به صورت مستقيم در استنباط فقه ي تأثيرگذار است. جامعيّت و كمال شريعت يكي از گزاره‌هاي كلامي مؤثر در تفسير متون ديني است. طبق قول مختار، دين براي سعادت دنيا و آخرت است. بر اساس جامعيّت دين مؤثر، متون ديني قابلِ تفسير، در همين راستا تفسير مي‌گردند. دين اسلام به تشريع احكام كلي و جزئي پرداخته، اما اين‌گونه وضع قوانين، به معناي كافي بودن آنها در همة ابعاد زندگي انسان‌ها نيست و لازم است در چارچوب قوانين شرع اقدام شود. يكي از نتايج مهم بحث جامعيّت و كمال شريعت، اشتمال دين بر دولت و نهاد اجرايي است. پذيرش اين قول به معناي تأسيس همة قواعد و اصول حكومت‌داري نيست، بلكه شريعت مي‌تواند بعضي از قواعد و اصول عُقلايي را تأييد، برخي را تخطئه و به اظهار ديدگاه خود اقدام نمايد

Some of the logical propositions are of direct influence on inferring religious laws completeness and perfection of religion is one of the theological propositions having important influence in the interpretation of religious texts. According to author view religion is for happiness in earthly life and the hereafter; so on the basis completeness of religion the religious texts are interpreted in this direction. Islam but such enactment of law does not include dimensions of human's life. It is necessary to enact some required laws in the frame of Islam. One of the important result obtained from discussion of universality and perfections of religious is the influence of religion in government and the executive institution. Yet this does not mean the establishment of all rules and principles of government; but also, religion can confirm some rational principles and rules; deny some others and performs according to its own viewpoint.
