بعد از مداقه و پژوهش در مورد اصل پيوند اعضا و دست يافتن به شيوه هاي جديد نگهداري اعضا به قصد پيوند، پرسشي نو را در اذهان پديد آورد؛ با فرض جواز اصل عمل پيوند عضو، آيا اين جواز مي تواند به نگهداري اعضا به عنوان مقدمه و يا عملي از پيش تعيين شده، جهت تسهيل و انجام به موقع عمل پيوند، تسري يابد؟ بررسي و تبيين ادله عدم جواز نگهداري اعضا، شامل روايات حاكي از نهي و نيز آثار ناگوار نگهداري عضو و پس از آن، نقد و بررسي ميزان دلالت هر كدام از ادله ديدگاه هاي رقيب و سنجش قابليت استناد و ميزان كاربرد آن ادله، فرآيند نوشتار پيشرو است. دلايل جواز نگهداري، مستفاد از برخي ادله اصل جواز عمل پيوند و نيز تطبيق گام بعدي است. تلاشي اجتهادي و فقهي به منظور رسيدن به نتيجه مناسب در راستاي استنباط حكم نگهداري اعضا شده است. ارائه شرايط خاص و ذكر چگونگي امكان جواز نگهداري اعضا سرآغازي جديد بر مسألهايي نوظهور است. اين جُستار مدعي است با لحاظ و تحقق شرايطي خاص، جواز و روايي نگهداري اعضا به قصد پيوند، متكي و مستند به ادله است. اين حكم جواز مي تواند كمك قابل توجهي به نجات جان انسانها داشته باشد

Consideration of the principle of body organ transplantation and the achievement of the new methods of the organ preservation for transplantation has led to the emergence of a new research question. Given the principle of organ transplantation is permitted, can this permission allow for the prior preservation of organs to facilitate the operation of transplantation? The current study is intended to carefully clarify and investigate the reasons of the ban on the preservation of the body organs such as the traditions and the unwholesome consequences of organ preservation. Likewise, the paper tries to analyze the opposite views and assess the applicability of the relevant reasoning. Moreover, the study is an attempt to investigate the reasons for organ preservation derived from the principle of organ transplantation and their compatibility. The present study is, therefore, a jurisprudential attempt to deduce the permission order of body organ preservation. The emergence of the special conditions and the possible methods of organ preservation have resulted in a new research question. This study claims that, in some special conditions, the permission for and the legitimacy of the preservation of body organs for transplantation is highly supported by jurisprudential reasoning. This permission can, in turn, contribute a lot to save the lives of the patients in need of body organs
