نقض حقوق بشر به واسطه اقدامات تروريستي و ساز و كار مبارزه با آن

Human Rights, the victim of terrorism and of mechanisms to combat it

نقض گسترده حقوق و آزادي هاي اساسي بشر از جمله سركوب سياسي، تبعيض هاي اجتماعي ، عدم روا داري و تحمل در برخورد با اقليت ها (مذهبي، نژادي و...)، به حاشيه راندن هرگونه صداي مخالف، يكي از موجبات اساسي نضج و گسترش خشونت و اقدامات تروريستي است. اما اعمال خشونت آميزي كه عموماً تروريسم ناميده مي شود مستقيم و غير مستقيم – باعث نقض حقوق بشر و آزادي هاي بنيادين شهروندان مي شود. از سوي ديگر، با عنايت به اينكه مقابله با جرائم تروريستي بايد به صورت سامانه مند و مداوم صورت گيرد و مستلزم اتخاذ تدابير نسبتاً شديد (در مقايسه با ساير جرايم ) است، همواره اين نگراني وجود دارد كه دولت ها (حتي سامانه هاي مبتني بر مردم سالاري و حاكميت قانون ) از مسير اعتدال و عقلانيت خارج شده و در چارچوب مبارزه با تروريسم، خود مرتكب نقض و يا تحديد حقوق بشر شوند. سوال محوري اين مقاله پيرامون بررسي ابعاد نقض حقوق بشر در پديده تروريسم با تكيه بر نظريه سازه انگاري بررسي مي شود. در اين تحقيق، با رويكردي تبييني و تكيه بر اسناد، از روش مطالعه كتابخانه اي استفاده شده است. يافته هاي تحقيق گوياي آن است كه اقدامات تروريستي با سلب حيات انسان هاي بي گناه و ساز و كار مبارزه با آن نيز در مواردي با نقض حريم و حقوق فردي، ناقض حقوق بشر تلقي مي شوند.

Terrorism clearly has a very real and direct impact on human rights, with devastating consequences for the enjoyment of the right to life, liberty and physical integrity of victims. In addition to these individual costs, terrorism can destabilize Governments, undermine civil society, jeopardize peace and security, and threaten social and economic development. All of these also have a real impact on the enjoyment of human rights . In recent years, however, the measures adopted by States to counter terrorism have themselves often posed serious challenges to human rights and the rule of law. Some States have engaged in torture and other ill-treatment to counter terrorism, while the legal and practical safeguards available to prevent torture, such as regular and independent monitoring of detention centers, have often been disregarded This paper has been prepared with the aim of strengthening understanding of the complex and multifaceted relationship between human rights and terrorism. It identifies some of the critical human rights issues raised in the context of terrorism and highlights the relevant human rights principles and standards which must be respected at all times and in particular in the context of counter-terrorism. Based on two theoretical debates, i.e realism and constructivism, we have developed our discussion. The research is characterized with an analytical –descriptive method.
