تحليل حقوقى بهره بردارى از ميادين مشترك نفت و گاز با تأكيد بر ميدان مشترك پارس جنوبى

Analyzing the Legal Conduct of Iran and Qatar in the South Pars Gas Field

ميادين مشترك نفت و گاز ساختارهاى هيدروكربورى هستند كه از مرزهاى جغرافيايى يك كشور عبور كرده و وارد قلمرو كشور ديگر مى شوند. افزون بر اين، برخى از ميدان هاى نفت و گاز در مناطق مورد اختلافِ حاكميتى دو يا چند دولت قرار مى گيرند كه در ادبيات حقوقى ميادين مشترك مطالعه مى شوند. حقوق بين الملل به عنوان ابزار نظم در روابط بين المللى داراى چارچوب كلى حقوقى در خصوص تنظيم رفتار دولت ها پيرامون بهره بردارى از ميادين است. پرسش اين نوشتار، رويكرد كلى حقوق بين الملل به طور عام؛ و هم چنين رفتار جمهورى اسلامى ايران و قطر در بهره بردارى از ميدان مشترك پارس جنوبى از منظر خاص است. نتيجه آن كه، رويكرد حقوق بين الملل مبتنى بر همكارى است و ميدان گازى پارس جنوبى به عنوان بزرگ ترين ميدان گازى مشترك جهان نيز از قاعده ى كلى همكارى مستثنا نمى باشد.

The trans-boundary oil and gas fields are the hydro carbon structures that cross territorial boundaries of one or more states . Furthermore some of oil and gas fields are located in the disputed areas and claimed by two or more states. These fields also studied in the international legal literature under category of trans-boundary reserves. International law as an instrument for regulating the international relations peresents general legal framework to exploitation of the trans-boundary oil and gas fields. In this article the author rises and answers some questions about the general approach of international law governing trans-boundary oil and gas fields and specially analyses legal conduct of the Islamic Republic of Iran and Qatar in South Pars gas field. The presumption of this article is that general rule in exploitation of shared or trans-boundary oil and gas fields is “cooperation” and Iran and Qatar also should be work together with cooperative approach.
