Jurisdiction of Senegalese Special Court: Advantage of the “Copy-Paste” Approach in Statutory Making

صلاحيت شخصى دادگاه ويژه سنگال كه در سال 2013 ميلادى تأسيس شد، تنها معطوف به حيسن هابره و هم دستان وى است و اتحاديه ى آفريقا و سنگال در تنظيم اساس نامه ى اين دادگاه تحت تأثير ديگر محاكم بين المللى كيفرى بوده است. مقاله ى حاضر ضمن تدقيق در صلاحيت هاى دادگاه ويژه سنگال، نشان مى دهد كه در اساس نامه نويسى اين دادگاه، از روش كپى و الحاق استفاده شده است. كاربست اين معيار، بايسته ى وحدت رويه ى قضايى و تقنين در جامعه ى بين المللى است تا بتواند تا اندازه اى خلاء نبود قوه ى واحد مقننه در گستره ى قضايا گردد؛ اما اين روش نبايد به مثابه اين هاني قضايا گردد چه در غير اين صورت، به ايستايى حقوق خواهد انجاميد. اساس نامه ى دادگاه مطروح كه برآمد تعامل حقوق داخلى و بين المللى است و با اين رويكرد تنظيم شده، تحسين برانگيز است.

The personal jurisdiction of the Senegalese Special Court, established in 2013, is limited to Hisson Hobre and his associates, and the African and Senegalese associations have been influenced by other international criminal justice courts in setting up the Statute of the Court. The present article, while analyzing the competencies of the Special Court of Senegal, shows that the method of copying and attaching was used in the statutory writing of this court. The application of this criterion is based on the unity of judicial and legislative practice in the international community in order to attain a degree of vacuum in resolving the legislative branch of the transnational corridor, but this method should not be regarded as a "standpoint" of cases; otherwise, Salary will go. The Statute of the Court, which results from the interaction of domestic and international law, is admirable with this approach.
