با توجه به ابهامات موجود در اصل يكصد و هفتاد و يكم قانون اساسى جمهورى اسلامى ايران پيرامون مسؤوليت شخصى قضات در صورت تقصير، اعمال قواعد عمومى مسؤوليت مدنى بر اقدامات قضات ضرورت مى يابد كه اين امر با خطرات ناشى از شغل آنان هم خوانى ندارد. نظام هاى حقوقى پيشرفته مسؤوليت مدنى قاضى را تابع عمومات ندانسته و محدوديت هايى را به صورت مطلق يا مقيد بر آن وارد كرده اند. اين نوشتار با مطالعه ى تطبيقى نظام هاى حقوقى فرانسه و ايران، به اين نتيجه مى رسد كه در حقوق فرانسه، افزون بر قاضى، تمام افراد دخيل در تكميل فرايند قضايى واجد مسؤوليت مدنى هستند و مصونيت مطلق قضات در جبران خسارات پذيرفته نشده است؛ ضمن اين كه براى جبران خسارات از ناحيه ى قضات (در فرض عمد يا تقصير سنگين) و يا جبران آن توسط دولت (در ديگر موارد) روش هايى پيش بينى شده است.
