تأثير هژموني در ايجاد نظم و امنيت بين‌المللي و توسعۀ حقوق بين‌الملل

The impact of hegemony in create of international peace and security and development of international law

معمولا روابط بين حقوق بين الملل و سياست بين الملل، رابطه اي تقابلي در نظر گرفته مي شود كه يكي دربرگيرنده عدالت و برابري و ديگري دربردارنده قدرت است. اغلب چنين فرض مي شود كه حقوق بين الملل به وسيله قدرت كاهش مي يابد؛ زيرا حكومت جهاني براي كنترل قدرت وجود ندارد و آنارشي گزينه هاي اجرايي را كاهش و اثر قوانين در روابط بين المللي را محدود مي كند. فرض اين مقاله اين است كه هژمون موجد، حامي و تثبيت كننده قواعد حقوقي بين المللي است. كشورهاي قدرتمند و مخصوصا دولتهاي هژمون براي كم كردن هزينه هاي مربوط به تثبيت صلح و امنيت بين المللي، ناگزير از نهادسازي و به كار گيري قواعد حقوقي اند، چنان كه حقوق بين الملل نيز براي تحميل قواعد خود به قدرت نياز دارد. اين مقاله با روش توصيفي- تحليلي و از منظري تاريخي قصد دارد به بررسي نقش هژمون در گسترش حقوق بين الملل بپردازد.

Usually the relationship between international law and international politics is considered reciprocal relationship that one includes fairness and equality and another one containing the power and it is often assumed that international law reduced by power, because there is no world government to control power and anarchy reduce the administrative options and restricts the effect of international law. Instead, this paper assumes that the hegemon is the creator, protector and fixing the rules of international law. Powerful states and especially hegemonic governments to reduce the costs associated with the consolidation of international peace and security, have forced to institutionalization and application of legal rules, As international law needs power to impose its rules. This paper aims to examine the role of hegemon on development of international law by historical perspective and descriptive- analytic method
