زمينه و هدف: برابر قوانين جاري، پليس مجوز حمل و بكارگيري سلاح در مواقع ضروري را دارد، اما قانون بكارگيري سلاح مصوب 1373 براساس شرايط و مناطق جغرافيايي، نوع ماموريت و وظايف تخصصي پليس ها تدوين نشده است و اين امر در بسياري مواقع موجب مسئوليت كيفري و مدني ماموران پليس شده است. اين پژوهش ضمن بررسي شرايط و ضوابط استفاده از سلاح، موارد سكوت مقنن، ابهامات و چالش هاي استفاده مرزبانان از سلاح در شرايط مختلف تيراندازي از جمله مناطق عملياتي درگير را بررسي نموده است. روش: پژوهش حاضر از نظر هدف، كاربردي و از نظر شيوه اجرا، توصيفي-تحليلي است. منابع پژوهش را قوانين موجود و اسناد معتبر در كتابخانه ها و منابع اينترنتي تشكيل دادهاند كه با بررسي آنها، موضوع مورد مطالعه تحليل شده است. يافته ها و نتايج: از آنجا كه رويكرد مقنن در موضوع حمل و بكارگيري سلاح در ماموريت هاي انتظامي، در تمامي شرايط و مناطق جغرافيايي يكنواخت و ثابت است، مشخص نبودن نحوه بكارگيري سلاح توسط مامورين مرزباني در مناطق و شرايط جوي دريايي و همچنين نبود مواد قانوني شفاف در رابطه با تيراندازي در مناطق ممنوعه مرزي، موجب ايجاد دوگانگي براي مامورين مرزباني در استفاده از سلاح شده است؛ بنابراين ضرورت دارد به منظور شفاف سازي استفاده از سلاح در شرايط جوي دريايي و همچنين مناطق ممنوعه مرزي، موادي در اين مورد به قانون بكارگيري سلاح اضافه شود.
