تاثير عدالت ترميمي بر تحقق اهداف كلان عدالت انتقالي

Restorative Justice and the Realization of the Goals of Transitional Justice

عدالت ترميمي يكي از راه هاي پاسخگويي به درخواست مردمي است كه پس از پايان يك دوره كشمكش يا حكومت ديكتاتوري، در جوامع انتقالي منتظر اجراي عدالت مي باشد. در اين نوع عدالت بر ساخت روابط ميان افراد و جوامع تاكيد مي شود و نتيجه حاصله، التيام قربانيان و خاموش ساختن حس انتقام براي باز پس گيري حقوق پايمال شده از طريق ترميم خسارات وارده است. در اين فرآيند مشاركت طرفين جرايم حقوق بشري اعم از بزه ديدگان، مرتكبين و نيز جامعه تحت تاثير جرايم، براي حل و فصل اختلافات مي تواند زمينه هاي جدي را جهت تحقق اهداف كلان عدالت انتقالي فراهم نمايد. اين اهداف را مي توان در سه مقوله، سازش و ختم خصومت، حكومت قانون و صلح پايدار خلاصه نمود. پرسش اصلي اين مقاله بررسي تاثيرات اجراي عدالت ترميمي بر روي ترميم و اصلاح جامعه انتقالي است كه منجر به تحقق اهداف كلان عدالت انتقالي مي شود. يافته هاي اين نوشتار گوياي اين است كه عدالت ترميمي با ماهيت نرم و قابل انعطاف خود نقش به سزايي در وصول به اهداف كلان عدالت انتقالي دارد.

The transitional justice basically follows three major goals in post-conflict societies, namely, reconciliation, rule of law, and sustainable peace. This article examines the role and the impact of restorative justice in realization of those goals. This article argues that the restorative justice helps achieve the goals transitional justice since it corresponds properly to the post-conflict situation in transitional societies. This article proposes that the restorative justice emphasizes the “individual-community” relation that aims at victims’ redress in human rights violations by involving victims, offenders, and the society in the process of transitional justice.
