بررسي الزامات حقوقي زيست محيطي صنعت بالادستي نفت و گاز در اسناد بالادستي جمهوري اسلامي ايران

A Review of Environmental Requirements Applicable on the Upstream Oil and Gas Industry Stipulated in theFundamental Legal Instruments of Iran

ايران به عنوان چهارمين مالك ذخاير نفتي جهان و بزرگ ترين مالك ذخاير گازي جهان به شكل محسوسي در معرض آلودگي هاي ناشي از صنعت نفت و گاز كه مهم ترين بخش اقتصاد كشور را تشكيل مي دهد، قرار دارد. بخش قابل توجهي از اين آلودگي ها از صنعت بالادستي نفت و گاز و بخش ديگري از صنايع پايين دستي اين بخش از اقتصاد كشور ناشي مي شود. الزامات حقوقي پيش بيني شده در قوانين بالادستي جمهوري اسلامي ايران كه بر صنعت بالادستي نفت و گاز قابل اعمال هستنددر اين پژوهش مورد بررسي قرار گرفته اند. اين اسناد شامل رويكرد قانون اساسي، قوانين برنامه اي و سند چشم انداز، سياست هاي كلي و نظاير آن مي شود. فرض اساسي اين مقاله بر اين مبنا استوار است كه قوانين و اسناد بالادستي در نظام حقوقي ايران رويكرد عمومي مشخصي را در مورد حمايت از محيط زيست در خلال فعاليت هاي مرتبط با صنعت نفت پيش بيني نموده اند. اين رويكرد را مي توان مشخصا در اصل پنجاهم قانون اساسي يافت.

Iran, as the holder of world’s fourth largest oil reserves and world’s largest gas reserves, is sensibly exposed to pollutions resulting from oil and gas industry which is its most important economy sector. A significant portion of these pollutions is caused by the upstream oil and gas industry and the remaining portion is resulted from the downstream oil and gas industry. The present research is dedicated to the legal requirements stipulated in Islamic Republic of Iran’s Fundamental Legal Instruments. These instruments include the Constitution, Five-year Development Plan, the Twenty-year Perspective Law, General Policies and similar documents. The central assumption of this study is founded on the idea that fundamental instrument of the Iranian Legal System have a solid general approach with regard to the issue of environmental protection in upstream oil and gas related activities. This approach is specifically evident in Principle 50 of the Constitution.
