جايگاه فقهي - حقوقي ورود سپاه پاسدارن انقلاب اسلامي به عرصه فرهنگي در راستاي تحقق رسالت پاسداري

The Legal- Juridical Question of the Islamic Revolutionary Guard Corps Entering To the Cultural Arena In Pursuit of the Mission of Guardianship

همزمان با پيروزي انقلاب اسلامي نهادهاي جديدي براي تحقق آرمانهاي انقلاب اسلامي تاسيس شد. سپاه پاسداران انقلاب اسلامي يكي از اين نهادهاست. درباره كاركردهاي اين نهاد تاكنون مباحث مختلفي مطرح شده است. برخي با تاكيد بر نظامي بودن اين نهاد ورود به حوزه هاي ديگري چون عرصه فرهنگي را ناصحيح مي دانند. در مقابل برخي ديگر با تاكيد بر اصولي چون اصل يكصد و پنجاه قانون اساسي بر كاركرد چند جانبه اين نهاد براي «نگهباني از انقلاب و دستاوردهاي آن» تاكيد دارند. در اين پژوهش براي شفاف شدن اين مسئله به بررسي موضوع ورود سپاه پاسداران انقلاب اسلامي به عرصه فرهنگي از منظر قانون اساسي جمهوري اسلامي پرداخته ايم. بر اساس بررسي هاي صورت پذيرفته در اين مقاله و ارائه ادله هاي «قرآني - روايي»، «اصولي» و «فقهي» مشخص شد كه سپاه پاسداران نهادي چند منظوره است كه براي مقابله با تهديدات گوناگوني كه انقلاب اسلامي را تهديد مي نمايد كاركردهاي متنوعي چون كاركرد فرهنگي دارد. لذا ورود اين نهاد به عرصه فرهنگي براي تقابل با تهديدات يكي از اصلي ترين ماموريت هاي اين نهاد به شمار مي آيد.

In the wake of the victory of the Islamic Revolution, new institutions were established to realize the ideals of the Islamic Revolution. The Islamic Revolutionary Guard Corps is one of these institutions. So far, numerous disputes have been raised about the functions of this institution. Some, with an emphasis on the military nature of this institution, consider entering into other areas such as the cultural arena as inappropriate. In contrast, others emphasize on principles such as the 150 article of Constitution to defend its multilateral functioning to "safeguard the revolution and its achievements." In this study, to clarify the issue, we will consider the subject of the entry of the Revolutionary Guard Corps to the cultural sphere in terms of the constitution of the Islamic Republic. Based on the findings of this paper and the provision of "Quranic-narrative", "principle" and "jurisprudential" evidence, it became clear that the IRGC is a multi-purpose institution which has designed to deal with the various threats that threaten the Islamic Revolution, so has various functions including cultural functionality. Therefore, entering into a cultural arena to confront threats is one of the main missions of this institution.
