تحليل گفتمان پليس متهم در حوزۀ زبان شناسي اجتماعي حقوقي

Analysis of Police-Suspect Discourse at the Field of Forensic Sociolinguistics

اولين هدف اين مقاله معرفي زبان شناسي اجتماعي حقوقي و كاربرد آن در تحليل گفتمان قضايي است. زبان شناسي اجتماعي حقوقي شاخه‌اي نوپا است كه از زبان شناسي كاربردي منشعب شده و با فرايندهاي حقوقي و قانوني جامعه در ارتباط است. در اين حوزۀ علمي اعتقاد بر اين است كه در تحليل گفتمان در بافت قضايي، عوامل اجتماعي بايد در نظر گرفته شوند. دومين هدف، شناخت ساختار گفتمان پليس - متهم و بررسي نقش پليس در اين گفتمان است. بدين منظور پانزده رويداد گفتماني مربوط به جلسات بازجويي پليس در موقعيت قضايي شهر تهران به صورت توصيفي - تحليلي مورد بررسي قرار گرفتند. در تحليل داده ها از روش مالكولم كلتارد و آليسون جانسون (2007)، كه در تحليل جلسات بازجويي انگليسي زبانان به‌كار برده‌اند و از تقسيم‌بندي نقش‌هاي اجتماعي زبان (هليدي، 1973) استفاده شد و در نتيجه، در اين پژوهش چارچوبي توصيفي براي تحليل گفتمان قضايي فارسي زبانان تدوين شد. نتايج حاصل از پژوهش نشان مي دهد كه در جلسات بازجويي، پليس تصويري از شرح واقعه را در ذهن دارد و به منظور ترغيب متهمان به اعتراف، اقدام به پرسش‌گري ميكند. از اينرو، گفتمان پليس - متهم در بازجويي قضايي از ساختاري هدفمند برخوردار است. نقش هاي اجتماعي زبان كه در حوزۀ زبان شناسي نقشگرا معرفي شده اند در رسيدن به هدف قضايي، كه گرفتن اقرار مكتوب و داوطلبانه از متهمان است، به پليس كمك مي كنند.

The first purpose of this essay is to introduce forensic sociolinguistics and its usages in forensic discourse analysis. Forensic sociolinguistics is a new branch of applied linguistics related to the law and legal processes of society. In this field of scientific study, it is believed that social factors should be considered in analyzing discourses in forensic context. The second purpose is to recognize the police-suspect discourse structure and to survey the role of police in this discourse. To do this, 15 discourse events of police interviews in forensic situation of Tehran have been surveyed analytic-descriptively. To analyze the data, the pattern of study suggested by Malcolm Coulthard and Alison Johnson(2007) in analyzing interviews of English speakers has been utilized; therefore, a descriptive framework for analyzing forensic discourse of Persian speakers are prepared. The results of this research show that in interviewing, police have a particular version of events in mind that they are attempting to confirm; they persuade suspects to confess. Therefore, police-suspect discourse in forensic situation has goal-oriented interview structure. Social functions of language which are introduced in functional linguistics help police achieve their forensic goal which is to elicit a voluntary written confession from suspects.
