چكيده فارسي :
پليس در تمامي نظام هاي حقوقي وظيفه برقراري نظم عمومي محور را بر عهده دارد و برقراري نظم عمومي نيازمند اعمال اختيارات ويژه و بهره گيري از وجه آمره بودن قانون است. با اين وجود نظم عمومي در مفهوم جديد و البته مبتني بر آموزه هاي اسلامي امري يك جانبه نيست و لازم است مقيد به الزامات مشخص و در خلال مشاركت اجتماعي و تعهد به سرنوشت مشترك مبتني بر اصل نهم قانون اساسي و با همكاري عامه مردم فراهم شود. اين همكاري نيز مبتني بر احساس كارا بودن مشاركت و اعتماد به پليس به عنوان امانتدار حوزه امنيت عمومي حاصل مي شود. در اين مقاله در پاسخ به اين سوال كه «مباني و سازوكارهاي حقوقي تحقق پليس مقتدر و امين مردم چيست؟» به طراحي الگوي حقوقي «پليس مقتدر، امين مردم» مي پردازيم به نحوي كه پليس در انجام وظايف قانوني خود در استقرار نظم و امنيت عمومي از كارآمدي مطلوب برخوردار شده و البته در نظر داريم كه اين كارآمدي نيازمند اعطاي تضميناتي عيني از جانب پليس به مردم است مبني بر اينكه پليس، نظم را در چارچوب قانون و منافع عمومي تعهد و تأمين مي كند، تسامح پذير و سليقه گرا نيست، تحت نظارت و راهنمايي هاي مراجع قضائي عمل مي كند، به حقوق و آزادي هاي مشروع مردم نيز تجاوز نمي نمايد. به اين ترتيب پليس درصدد استقرار امنيت شهروندمدار و اجتماعي شده است كه با شهروندان بر اساس اخلاق حرفه اي و با برهم زنندگان نظم عمومي با قاطعيت مورد حمايت قانون برخورد موثر مي نمايد.

In all legal systems, the police have the task of establishing a public-centered order, and the establishment of public order requires the exercise of special powers and the enjoyment of the law. However, public order in the new sense, and, of course, based on Islamic teachings, is not unilateral, and must be bound by specific requirements and through social participation and a commitment to a common destiny based on the Ninth Principle of the Constitution and in cooperation with the general public. The partnership also builds on the sense of participation and trust in the police as trustees of the public security domain. In this article, in response to the question, “What are the legal bases and mechanisms for the realization of a strong and trustworthy police?” We are designing the legal pattern of “a strong police, trustworthy people” so that the police can perform their legal duties in establishing order and order. Public security is well-functioning and, of course, we consider that it requires that the police provide objective guarantees to the public that the police are committed to the law and in the public interest, tolerant and tasteful. It is non-discriminatory, operates under the supervision and guidance of judicial authorities, and does not violate the legitimate rights and freedoms of the people. As such, the police have sought to establish citizen centered and social security that treats citizens on the basis of professional ethics and disrupts public order in a law-abiding manner.
