Fundamental analysis of the differences between Marriage and, liaison, in Islamic law

مقوله نكاح و پيوند مشروع ميان زن و مرد در تمامي جوامع بشري با همه تنوّع فرهنگي، امري پذيرفته شده است. حقيقت ياد شده در هر نظام حقوقي بر پايه اصول و قواعدي است كه اخلال بدانها پيوند مزبور را نامشروع ساخته موجب تحقق سفاح در برابر نكاح مي گردد؛ در اين جستجو برآنيم تا با تحليل نگاه شارع به نهاد حقوقي نكاح و قاعدۀ فقهي «لكلّ قومٍ نكاح»، دو عنصر:" چارچوب منضبط در آثار و احكام" و "رسميّت بخشيدن به آن، به دليل هم سويي با هنجارهاي عقلايي "- به گونه اي كه در نگاه عرف آن جامعه، صريحاً دالّ بر نكاح تلقّي شود- را دو ركن اصلي نكاح بدانيم كه- متناسب با فرهنگ ملل مختلف و با انضباط و اسباب ويژۀ هر قوم و آيين- به اين رابطه، مشروعيّت مي بخشند و اسلام نيز آن را معتبر مي داند؛ چه، اهميّت امر نكاح در اسلام، به معناي سخت گيري در اسباب ايجاد رابطۀ زوجيّت نيست و تنها تحقّق اين دو عنصر، موجب اعتبار آن، به عنوان نكاح در ميان تمامي اقوام و آيين ها، از جمله آيين اسلام، مي گردد.

Marriage as the lawful relationship between men and women is an acceptable social event in all human societies even though there are vast differences in how it is usually realized. It is based, in every society, on some principles which make it legal and if they are ignored the relationship changes to adultery. They present study seeks to explore Sharia laws in this relation and considering the famous tradition " There is marriage for all nations" explain the systematic framework considered for it in Islam. Two basic principles are discussed: a) systematic framework for marriage as the lawful relationship between men and women and for its rules and consequences and b) Formalizing marriage as the lawful relationship between men and women to make it in line with reasonable social norms. The study aims to show that Islamic rules are not strict inhibitors of marriage but actually conform to the basic principles acceptable in all other nations and ideologies.
