Economic Analysis of Law: Securance of minimum welfare, Reducing Embezzlement

از نيمه دوم قرن بيستم، در قلمروي فلسفه حقوق، حوزه­ جديدي با عنوان «تحليل اقتصادي حقوق» مطرح شده است. اين ساحت انديشه­ اي، موضوعات حقوقي را با ابزارهاي اقتصادي بررسي مي ­كند. لذا چنين سطح تحليلي، نخست موضوع حقوقي را به زبان اقتصادي ترجمه كرده و در چارچوب منطق اقتصادي به استنتاج مي ­رسد. در نوشتار حاضر، به تحليل اقتصادي پديده اختلاس در بين كارگزاران حوزه عمومي پرداخته شده و پيامدهاي تأمين حداقل رفاه در جهت كاهش اختلاس كارمندان به بحث گذاشته شده است. روش­ شناسي اين نوشتار، از روش توصيفي­ - ­تحليلي پيروي كرده است. تحقيق حاضر در صدد پاسخ به اين سوال كليدي است: از منظر تحليل اقتصادي حقوق، چه نسبتي بين تأمين حداقل رفاه و كاهش اختلاس وجود دارد؟ در پاسخ به اين سوال، پس از ذكر كليات و مفهوم شناسي، مولفه حداقل رفاه كارمندان در برابر اختلاس را با استفاده از منطق تحليل اقتصادي به بحث گذاشته­ و چنين نتيجه ­گيري كرده­ايم كه نسبت معنا داري بين دو متغير: «تأمين حداقل رفاه» و «كاهش زمينه­ هاي اختلاس» وجود دارد. در اين صورت يكي از راهكارهاي كاهش اختلاس در دستگاه­ هاي اجرايي را مي­ توان به تأمين حداقل رفاه كارگزاران عمومي پيوند داد؛ وضعيتي كه حوزهاي: تقنين و اجرا در اجرايِ مطلوبِ آن، ناتوان بوده­ اند.

In the second half of the twentieth century, in the realm of philosophy of law, has been proposed a new field called "economic analysis of law." This is the realm of thought, survey Legal issues with economic tools. Therefore, this level of analysis, first, legal issues has translated into economic and in the context of economic logic to deduce it. In the present article, it is mentioned the economic analysis of the Embezzlement phenomenon in among public realm and it is discussed minimum welfare consequences in order to reduce embezzlement of employees. Methodology this Article, has followed descriptive - analytical method. This study seeks to answer these key questions: From the perspective of economic analysis of law, what is the relationship between securance of minimum welfare and reducing embezzlement. In response to this question, after mentioning generalities and meaning, discussed the category of minimum welfare of employees against embezzlement with use the economic analysis logic and we have concluded that there is significant ratio between the two variables: securance of minimum welfare, reducing embezzlement. Thus one of ways to achieve the reducing of embezzlement in the executive agencies, safeguard the minimum welfare of the public employees; that's what the Legislative and the execution spheres have been unable in its optimal performance.
