The Study of Theory, Meta-Theory, Method and Methodology in International Law

روابط انسان‌‌ها با يكديگر و با محيط پيراموني، در طول تاريخ، پيوسته تغيير كرده است. از اين­رو تحول، ويژگي جداناشدني حيات انسان است. اين تحولات به خلق و محو پديده‌هاي مختلف اجتماعي و مناسبات ميان آن‌ها، به‌عنوان موضوع علم حقوق منجر مي‌شود. علما و انديشمندان حقوقي با درك اين وضعيت، وظيفه خود را تدوين ايده‌ها و نظرياتي مي‌دانند كه هرچه بهتر بر اين پديده‌ها انطباق داشته و به بهترين نحو با طراحي و توسل به بهترين فنون، بتواند نظم ميان آن‌ها را توصيف و راهبري كرده يا در صورت فقدان نظم، به تنظيم مناسبات اين پديده‌ها كمك كند و هم­زمان به افق‌هاي مطلوب پيش رو هدايت نمايد. مسائل نظري حقوق بين‌الملل به مثابه آوردگاه برخورد ديدگاه‌هاي متمايز در قلمرو زندگي و مناسبات انساني، امروزه بيش از پيش محتاج هدفمندشدن و انسجام‌يافتن است. بايد ابزارها، اسلوب و فنون حقوقيِ اين مهم را در محتوا و روش مطالعه حقوق بين‌الملل دنبال كرد. بر همين اساس در اين مقاله، چهار مفهوم نظريه، فرانظريه، روش و روش‌شناسي با هدف برداشتن قدمي ولو اندك در راستاي آگاهانه­ كردن مبادي دانش‌ورزي در قلمرو مسائل پژوهشي در حقوق بين‌الملل مطالعه خواهد شد و به اين ترتيب، اهميت مسائل نظري و روش‌هاي نظريه‌پردازي حقوقي در ساحت حقوق بين‌الملل با تأكيد بر فايده و ضرورت مطالعه چند روشي در قلمرو حقوق بين‌الملل، با كمك‌گرفتن از فنّ فرانظريه‌ پردازي حقوقي بازانديشي مي‌شود.

Human beings’ communication with each other and with the peripheral environment has been continuously changed. Hence, transformation is an indispensable feature of human life. These developments lead to the creation and elimination of various social phenomena and their relationships as the subject of science of law. By understanding this, legal scholars are committed to formulate ideas and theories that best fit these phenomena and by designing and resorting to the best techniques, in the best way, to describe and guide the order among them or, in the absence of such an order, to help regulate the relationships of these phenomena and at the same time direct them to the desired horizons ahead. The theoretical issues of international law as the battlefield for encountering of different views, require more intelligence and coherency. Tools, methods and techniques of these characteristics should be followed in the content and method of studying international law. Accordingly, in this paper, the four concepts of theory, meta-theory, method and methodology with the aim of taking a small step towards the consciousness of scholarship in the field of research in international law will be studied, and thus the importance of theoretical and methods of legal theorization in the field of international law, with emphasis on the usefulness and necessity of studying multi-methods in the field, are redefined with the help of technique of legal meta-theory.
