جريان‌شناسي انتقادي حقوق بشر با تحليل مفهوم پايه از كرامت انسان مبتني بر اسلام و مسيحيت

A Critical Typology of the Human Rights by Analyzing the basic Concept of the Human Dignity based on Islam and Christianity

حقوق بشر در دنياي معاصر، بسان گفتمان غالب ارزيابي و ارزش داوري انسان تراز قرن بيست و يكم به كار بسته مي‌شود؛ كاربستي كه رفته‌رفته ابعاد حقوقي آن به سويه‌هاي سياسي، امنيتي و حاكميتي‌اش سرازير مي‌شود و به نُرمي از حكومت‌داري بدل مي‌گردد؛ استاندارد فزوني‌طلبي كه هر ملاك و فهمي را ولو مبتني بر اديان و تمدن‌هاي كهن، به گوشة انزوا مي‌نهد. پايه‌اي‌ترين مفهومي كه حقوق بشر معاصر خود را بر آن بنا نهاده، كرامت انسان است. تحليل هندسة مفهومي حقوق بشرِ مبتني بر كرامت، چالش‌هاي پنهاني را به عرصه مي‌كشد كه تاكنون مجال چنداني براي ظهور و بروز نداشته‌اند. جريان مطالعات انتقادي حقوق بشر كه ضمن ريشه‌يابي اين‌گونگي آن به‌روش تاريخ‌نگري، به نقد بنيادهاي نظري، روش‌شناسي ارزش‌آفريني، هنجارسازي حقوقي، كاركردها و از همه مهم‌تر آوردة حقوق بشر در دنياي كنوني مي‌پردازد، مورد تحليل و جريان‌شناسي مقالة حاضر قرار گرفته و در ضمن چند پرسش اصلي، به بازخواني انتقادي هويت كرامت انسان و جايگاه و دلالت‌هاي حقوق بشر پرداخته است. آنچه پيش‌رو داريد، تلاشي است مبتني بر روش تحليل هندسة مفهومي، بازشناسي شبكة دانشي و تطبيق كاركردي بين ادبيات رايج حقوق بشري، اسلام و مسيحيت.

The issue of the human rights is considered as a means of assessing and valuing man in the 21st century to the extend that due to the expansion of its legal dimensions towards politics, security and sovereignty is about to become a norm and standard in governingـــــــ an unjust standard that isolates all types of criterion and understanding, even religious and civilized understandings. The most basic concept behind the contemporary human rights is the human dignity. Conceptual analysis of th human rights based on dignity leads to hidden challenges that have so far not been discussed. While analyzing the identity of human dignity, its status, and the implications of the human rights, this paper examines the critical human rights studies that historically criticize the theoretical foundations, methodology, value creation, legal normalization, functions and the human rights in the current world. The function of the conceptual analysis, is recognizing the network of knowledge and making a functional alignment between the common human rights literature of Islam and Christianity.
