تأثير قانون جديد رسيدگي به تخلفات راهنمايي و رانندگي بر كاهش تصادفات و تخلفات (مطالعه موردي: شهر تهران)

The Effect of New Law on Traffic Violations on Deterrence and reducing Traffic Accidents and Violations (Case: City of Tehran

رانندگي بدون رعايت قوانين و مقررات راهنمايي و رانندگي، نظم و امنيت هر جامعه‌اي را تهديد و باعث سلب آسايش و آرامش افراد آن جامعه مي‌شود. با توجه به تصويب قانون جديد رسيدگي به تخلفات و افزايش 289 درصدي تخلفات سال 1395 نسبت به سال 1389، هدف اين تحقيق، بررسي ميزان بازدارندگي قانون جديد رسيدگي به تخلفات بر تصادفات و تخلفات شهر تهران مي‌باشد. اين تحقيق از نظر هدف، از نوع كاربردي و از لحاظ روش انجام، تحليلي- توصيفي از نوع پيمايشي است. براي جمع‌آوري داده‌هاي تحقيق، از پرسش‌نامه محقق‌ساخته كه داراي يك فرضيه اصلي و سه فرضيه فرعي با 43 گويه است، استفاده شده است و بين جامعه آماري كه همان رؤساي مناطق 26گانه پليس راهور تهران بزرگ هستند، توزيع شد و پس از تكميل پرسش‌نامه به‌وسيله نرم‌افزارهاي SPSS و PLS و آزمون تي‌تست و فريدمن، تجزيه و تحليل شده است. يافته‌هاي تحقيق نشان مي‌دهد در سطح اطمينان 99 درصد، بين شدت، حتميت يا قطعيت و سرعت اجراي قانون جديد و بازدارندگي، از تصادفات و تخلفات تأثير مثبت و معناداري وجود دارد. نتيجه اين تحقيق نشان مي‌دهد برخورد فوري و مجازات شديد مانند: ضبط گواهي‌نامه، توقيف خودرو و استفاده از مجازات‌هاي تكميلي، محروميت اجتماعي، عزل‌ شدن از مسئوليت در موارد خاص و ... در بازدارندگي از تخلفات و تصادفات تأثير مثبت و معناداري دارد. افزايش سامانه‌هاي هوشمند ثبت تخلفات در معابر، بر بازدارندگي از تخلفات و تصادفات و كاهش تخلفات، مؤثر است. همچنين مشخص گرديد كه مجهز كردن پليس به تجهيزات مناسب براي تسريع در برخورد با تخلفات حادثه‌ساز بر بازدارندگي از تخلفات و تصادفات تأثير مثبت و معناداري دارد. اعلام محروميت رانندگي توسط مراجع قضايي و نظارت و كنترل بر آنها توسط ابزارهاي خاص، در بازدارندگي از تخلفات تأثيرگذار است.

Driving without observance of driving laws and regulations threatens the order and safety of any society and disrupts the comfort of the people of that society. According to the new law on defamation and 289 percent increase in violations in 2016 compared to 2010, the purpose of this study is to investigate the deterrent effect of the new law on the investigation of violations of accidents and offenses in Tehran. In terms of purpose, this research is applied and analytical-descriptive survey type in terms of method. To collect the research data, a researcher-made questionnaire with a main hypothesis and three sub-hypotheses with 43 items was used and distributed among the statistical community that is the same as the heads of the 26th districts of Tehran police corridor and after completing the questionnaire by SPSS software and PLS and the T-test and Friedman tests have been analyzed. The results indicate that there is a positive and significant effect on accidents and violations at 99% confidence level, between severity, prudence or certainty, and the speed of new law enforcement and deterrence. The results also show that immediate treatment and severe punishment such as record keeping, vehicle seizure and the use of additional penalties, social exclusion, dismissal of liability in specific cases, etc. have a positive and significant effect on deterrence of violations and accidents. Increasing smart systems for recording road violations affects preventing violations and accidents, and reducing violations. It was also found that equipping the police with the appropriate equipment to accelerate the handling of incident violations had a significant positive effect on the deterrence of violations and accidents. Declaring driving disqualifications by judicial authorities and controlling them by specific means is effective in deterring offenses.
