Examples and Identification Factors of Military Personnel in light of the Code of Criminal Procedure of 1392

هدف مقاله، شناسايي معيار جداسازي ضابطان نظامي از ديگر ضابطان در قانون آيين دادرسي كيفري، شناسايي مصداقهاي ضابطان نظامي در اين قانون و شناسايي معيارهاي قانونيِ تشخيص ضابطان نظامي در نيروهاي مسلح است. در اين نوشتار با بررسي و تحليل در منابع حقوقي، اسناد قانوني و آراي قضايي به صوررت تحليلي و ه مچنين مصاحبه با تعدادي از خبرگان حقوقي، مصداقهاي ضابطان نظامي و معيارهاي قانوني شناسايي آنها بر مدار قانون آيين دادرسي كيفري مصوب 1392 تبيين و ارائه شده است. يافته هاي اين پژوهش حاكي است كه شاخصهاي قانوني شناسايي ضابطان نظامي شامل نظامي بودن، مورد اعتماد و وثوق بودن، كسب مهارت و آموزشهاي لازم و گرفتن كارت ويژه، مأمور بودن از سوي مرجع قضايي صلاحيتدار، تحت نظارت و تعليمات مقامات قضايي صلاحيتدار بودن است.

The purpose of the paper is to identify the criteria for the separation of military agents from other lawyers in the judiciary law, to identify the military authorities in this law, and to identify the legal criteria for identifying militants in the armed forces. In this paper, by analyzing and investigating legal ources, legal documents and judicial decisions with further analysis, and interviews with a number of legal experts, examples of military perpetrators and legal criteria for identifying them on the basis of the Code of Criminal Procedure, approved in 1392, are presented. The findings of this study indicate that legal indicators for the identification of military agents include military, trust and loyalty, acquisition of skills and training and obtaining the special card, being mandated by a competent judicial authority, under the supervision and training of competent judicial authorities.
