چكيده فارسي :
دگرباشي يا دگرزيستي بعنوان رفتاري انحرافي ، صرفا به معناي همجنس گرايي نيست ، بلكه به اشكال متفاوت ديگري نيز در جامعه نمايان مي گردد. مقاله پيش رو در پي شناخت رويكرد نظام حقوقي اسلام و كشف ظرفيت هاي آن به منظور برقراري نظم و عدالت اجتماعي در مواجهه باچنين پديده نوظهور اجتماعي است .
روش: براي شناسايي رويكرد نظام حقوقي اسلام ، از روش توصيفي _ تحليلي ومقايسه اي ، و در گرد آوري داده هاي آن از آيات ، احاديث ، تاليفات فقهاي اسلام استفاده شده است. يافته ها : اين نوشتار بواسطه دستاوردهاي تحليلي خود ، سه رهيافت متفاوت را ارائه مي نمايد . رهيافت تكليف مدار كه به دلايل مصلحت گرايي ، بر مداخله حداكثري حكومت در آزادي افراد تاكيد دارد. رهيافت حق مدار كه آزادي افراد در رفتار و چگونه زيستن را تا هنگامي كه در تلاقي با حقوق ديگران قرار نگرفته ، پذيرفته است و بر مداخله حداقلي حكومت اصرار دارد و رويكرد تلفيقي كه ضمن لحاظ نمودن حقوق و آزادي افراد و مصلحت جامعه ، حدود جرم انگاري اين گونه رفتارها را مشخص كرده است . بحث : بنظر مي رسد رويكرد تلفيقي با جوامع متكثر و باز امروزي همنوايي دارد ؛ زيرا رويكرد وظيفه بنيان و تكليف مدار ، امنيت مدار ونتيجه آن تورم حقوق كيفري ومداخله در حريم خصوصي افراد است . رويكرد حق مدار نيز هرچند بر مسامحه و مدارا استوار است ، ولي ممكن است به بي بند وباري بيانجامد.
چكيده لاتين :
Introduction: The principles of the School of Natural Rights during the Age of Enlightment, i.e., the 17th and 18th centuries, regarding the individuality of human beings, their freedom and self-determination, as well as the human rights recommendations and documentations are designed and drafted by the international organizations during the current century and the appearance of “Global-ization”, the cultural seeds have been planted in different human societies. Consequently, we have seen (nowadays) that relying on concepts of freedom, intellectualism, natural rights, self-determination, independency, and tendency towards consumerisms; some people have relieved themselves from observing the religious, traditional, and customary values, and have displayed un-conventional styles of life, which is different from the normal and conventional lives of other peo-ple in the society. Using the merits of technology and the appearance of the concept of “Globali-zation”, this culture is being increasingly widespread throughout the world using the platforms, such as the internet, satellites TV, and consumptive goods.
However, this Study is not designed to find the roots of the “divergence” or providing approaches to fight against this global phenomenon. In fact, following the appearance of divergence in the Is-lamic society, this Study is aimed at the identification of Islamic legal system approach(es) and dis-covery of its capacities in order to create a kind of balance in the society and establish social order and justice.
