مفهوم رضايت و جايگاه آن در اخلاق زيستي

The concept of consent and its place in Bioethics

اكثر اسناد حقوق بشري بالاخص بيانيه جهاني اخلاق زيستي و حقوق بشر شامل ماده‌هاي متعددي است كه منحصراً به مسأله رضايت مربوط مي‌شود. اين بيانيه و نيز گزارش متعاقب كميته بين‌المللي اخلاق زيستي درباره «رضايت‌نامه» به شكل چشم‌گيري مفهوم قانوني «رضايت» را به مفاهيم گسترده‌تر و جزئي‌تري مانند احترام به شأن و منزلت تماميت و خودمختاري مرتبط مي‌سازد، هرچند گزارش مربوط به «رضايت‌نامه» داراي دامنه گسترده‌اي است كه تنها بخش‌هايي از آن در اين مقاله مد نظر قرار گرفته است، ليكن مفهوم و جايگاه رضايت در اسناد حقوق بشري و ارتباط مابين اصل رضايت و اصل خودمختاري با كرامت انساني در اين مقاله در قالب يك كليت بررسي شده است.

Most human rights instruments, especially the Universal Declaration on Bioethics and Human Rights contains several provisions which are concerned exclusively with the issue of consent. Although the report on "consent" has a wide range that only parts of it have been considered in this article But the concept of consent in human rights instruments and the relationship between the principle of consent and the principle of self-determination, human dignity as a whole, have been reviewed in this article.
