حقوق فردي شهروندي در جمهوري اسلامي ايران با رويكرد فقهي امام خميني (ره)

Individual Citizenship Rights in Islamic Republic of Iran Focusing on Jurisprudential Approach of Imam Khomeini

در قرآن كريم مكرراً تصريح ‌شده كه خداوند متعال مواهب عالم را براي انسان آفريده‌، لذا بين او و مواهب آفرينش نوعي ارتباط وجود دارد. خالق جهان هستي و مدبر امور، قوانين حاكم بر افراد و جوامع انساني را وضع ‌كرد و انسان را مكلف به اطاعت از دستورات و قوانين قرار داد. در سيره پيامبر اكرم (ص) و نوع تعامل ايشان با افراد جامعه نيز حقوق هر فرد به عنوان شهروند، همواره در دستور كار بوده است. منابع اسلامي به ويژه تشيّع، جنبه‌هاي مختلف حقوق فردي شهروندي در حكومت اسلامي را به طور مستقيم و غير مستقيم مورد بررسي قرار داده است. امام خميني (ره) اسلام‌شناسي خبره بود و اساساً ديدگاههاي مختلف سياسي و اجتماعي ايشان مبتني بر برداشت و تفسير ايشان از منابع اسلامي بود. ايشان ديدگاه‌هاي مختلفي را در زمينه الگوهاي راهبردي نظام جمهوري اسلامي ايران، ضرورت تبيين هرچه بيشتر و بهتر منابع اسلامي و شيعي نمايان ساخت. اولين حق انسان، حق نفس و شناخت جايگاه حقيقي خويش به عنوان اشرف مخلوقات است كه با توجه به آيات قرآن كريم و سخنان ائمه اطهار (ع)، شناخت حقوق اموال و افراد در جامعه مورد عنايت اين مقاله ميباشد، لذا در اين راستا، پژوهش حاضر با استفاده از روش‌هاي تحقيقي كتابخانه‌اي، ميداني و مطالعه اسنادي، حقوق شهروندي فردي را در حكومت اسلامي ايران با استناد به بيانات امام خميني (ره) مورد تحقيق و پژوهش قرار داده است.

In Holy Quran it has been frequently stipulated that God has created the bounties in the world for mankind and there is a kind of relationship between the created bountie and him. The Creator of the universe and the Lord of all affairs has codified the laws governing the individuals and human societies and obligated man to observe the divine rules and regulations. The rights of every human individual as a citizen have been observed by the Holy Prophet (peace be upon him) in his relations with them. Islamic sources particularly those of Shia origin have addressed various aspects of individual citizenship rights in Islamic government in direct and indirect ways. Imam Khomeini was a seasoned expert in Islamic studies and his various political and social ideas were basically grounded in his interpretation of the Islamic resources. He revealed various perspectives concerning the strategic patterns of Islamic Republic of Iran as well as the necessity of better and further explanation of the Islamic and Shia sources. The first human right is the right to selfhood and knowledge of one's true place as the noblest creature on the planet that is assayed by the current essay in the light of the verses of Holy Quran, words of divine saints and the knowledge of the property rights of individuals. Then, to this end, the present study using a library based research method, documented studies deals with the individual citizenship rights in Islamic Republic of Iran based on the words of Imam Khomeini.
