Conscription: Rule of Law and Citizenship Rights

زمينه و هدف: نظر به نقش حاكميت قانون در تحقق حقوق شهروندي در مقولات مختلف زيست اجتماعي، اين تحقيق با هدف آسيب‌شناسي خدمت سربازي از اين منظر انجام شده است. مواد و روش‌ها: اين مقاله با روش تحليلي و تفسير همگراي قانون پس از اشاره اجمالي بر نظريه حاكميت قانون، در پي پاسخ به اين پرسش است كه عناصر قانونمندي نظام سربازي در ايران كدام است؟ نقاط قوت و ضعف اين نظام جهت تحقق حقوق شهروندي و حاكميت قانون چيست؟ يافته‌ها: فراگيري خدمت سربازي نسبت به تمامي اولاد ذكور عاملي مؤثر در تعميق حاكميت قانون است. هم‌ترازي و تساوي همه جوانان ايراني فارغ از قوميت، پايگاه اجتماعي، تحصيلات و...، عاملي مؤثر در تثبيت انگاره تساوي در برابر قانون براي همه شهروندان است، اگرچه پار‌ه‌اي رويه‌هاي نادرست و زمينه‌هاي بحران زا مي‌تواند عامل نقض حقوق شهروندي سربازان گردد. نتيجه‌گيري: اجراي بدون تنازل و تبعيض قانون، تأكيد بر شهروندي سرباز و محوريت آموزش حقوق و تكاليف قانوني خاصه قانون اساسي، ضمن تقويت حقوق شهروندي سربازان، تثبيت اين حقوق در جامعه را نيز به دنبال خواهد داشت.

Background and Aim: Given the role of rule of law in implantation of civil rights in different aspects of social life, this research would study pros and cons of mandatory military service. Materials and Methods: This paper adopts an analytical interpretative approach to the functional system of law. It is looking after a brief notation on the theory of rule of law, seeking to answer the questions as to what the legitimacy of Iran's system of conscription and strengths and weaknesses of this system compared to the culture of rule of law in Iran are. Findings: Inclusive nature of mandatory military service which covers all sons is an effective element in penetration of rule of law. Equal treatments whit all Iranian young man, regardless of their ethnic origins, social background, education and etc… has a constructive role in deeping the idea of citizen’s equality under the law. Should bear in mind some wrong procedures can lead to violation of civil rights of soldier. Conclusion: The complete implementation of law, emphasizing on this fact that soldier is a citizen along with education of rights and responsibilities, especially the constitution will to consolidation of soldier’s civil rights and the rights in society in general.
