امنيت و نظم عمومي در اسلام با تأكيد بر سياست هاي كيفري فقه اسلامي

General Security & Order in Islam with Emphasis on Islamic Jurisprudence Penal Policies

در اين مقاله ضمن مروري بر مفهوم امنيت و ابعاد آن، نسبت حقوق و امنيت و امنيت و نظم عمومي از نگاه درون ديني با تأكيد بر سياست هاي كيفري فقه اسلامي در دو زمينه جدا گانه امنيت عمومي و در دو حوزه اساسي و مكمل امنيت فكري ـ فرهنگي و امنيت سياسي ـ اجتماعي بررسي شده و در كنار آن نگاه تحليلي به برخي مصاديق اصلي تهديد كننده آنها از جمله ارتداد و محاربه و راهكار هاي مقابله با آن، با تأكيد بر مسئوليت حكومت ديني، شده است. سؤال اصلي پژوهش تبيين امنيت و نظم عمومي در اسلام با تأكيد بر سياست هاي كيفري فقه اسلامي است. روش انتخابي براي دستيابي به هدف، تحليل محتوا و پژوهش اكتشافي در متون ديني است.

In this article, meanwhile, reviewing the concept of security and its dimensions, we have attempted to study relation between law and security, and general security and order from religious viewpoint, with emphasis on Islamic jurisprudence penal policies in two separate fields of general security and in two fundamental and complementary scopes of mental-cultural security and politic-social security. In addition, some of main threatening cases including apostasy and warfare, and counteraction ways against it, with emphasis on religious government responsibility will be examined. The main question in this essay, would be explaining of general security and order in Islam, with emphasis on Islamic jurisprudence penal policies, and the way to achieving the purpose, had been content analysis and exploratory research within religious scriptures.
