حدود روابط جنسي زن و شوهر در چارچوب قاعده معاشرت به معروف

The Framework of Sexual Relations between Wife and Husband in the Light of Jurisprudential Rule of “The Necessity of Behaving Reasonably in Marital Relationship”

اين مقاله بر پايه التزام به قاعده لزوم معاشرت به معروف، به نقد و بازنگري ديدگاه هاي رايج فقهي و حقوقي در حوزه روابط جنسي زوجين، مي پردازد. بر پايه اين قاعده از جمله ضوابط وضع احكام در حوزه روابط زناشويي همچون ديگر قلمروهاي رابطه زن و شوهر- صدق رفتار متعارف است. مفاد قاعده، رعايت معيار متعارف در روابط جنسي را الزامي مي نمايد. بر اين پايه، نظريه تحديد زماني حق جنسي زوجه به هر چهار ماه يك بار، با معيار رفتار متعارف ناسازگار است. به همين ترتيب به حكم مضمون قاعده در هر بار رابطه جنسي نيز معيار رفتار متعارف بايد مراعات شود. در نتيجه، برقراري رابطه مبتني بر اجبار، شيوه هاي نامتعارف نزديكي و برقراري رابطه جنسي خشن، به لحاظ مغايرت با معروف نمي تواند مشروع باشد. مقاله با تاكيد بر پويايي مفهوم معروف و متعارف و امكان اثرپذيري آن از عرف هاي مقبول نتيجه مي گيرد كه گاه رفتارهايي كه پيشتر معروف بوده اند اما اكنون نامتعارف قلمداد شوند نمي توانند مقبول شارع باشند. مقاله همچنين به منظور روزآمدسازي قوانين مدني ايران در اين زمينه پيشنهادهايي ارائه نموده است.

This article studies the currently views of Islamic jurisprudence along with Iranian legal system’s position on sexual relations. According to the rule, all legal aspects of marital relationship including sexual issues should be in the framework of reasonable and rational behavior. Accordingly, limiting the right of wife to sexual relation with her husband in one time per four months, as it is determined in traditional jurisprudence, cannot be acceptable; because of its inconsistency with the criterion of reasonable behavior. Similarly, in every single sexual relationship the criterion of reasonableness should be observed. Therefore, sexual relation by force, violent and unreasonable methods of sexual intercourse are impermissible. Considering the fact that the concept of reasonable behavior is dynamic and changeable under the influence of difference in costumes and culture, the article concludes that a reasonable behavior in previous communities might be evaluated as unreasonable in our time. The article also makes some suggestions for improvement in Iranian family law in terms of sexual relations.
