مسئوليت مدني و اخلاقي دولت در اعمال سياست هاي مالي بر مبناي ضابطه تقصير سنگين

مسئوليت مدني دولت امري است كه از بدو تشكيل دولت هاي مدرن محل چالش بوده و فراز و فرودهاي فراواني را تجربه كرده است. يكي از عرصه هاي نسبتا جديدتر در اين زمينه، مسئوليت مدني ناشي از سياست هاي مالي دولت مي باشد. اين سياست ها به نحو قابل توجهي بر سرنوشت افراد جامعه و فعالان اقتصادي موثر بوده و بعضا موجب خسارت هاي فراواني به ايشان شده است. بر اين اساس لازم است تا ضمن بررسي ماهيت اين سياست ها از حيث قرارگيري در دسته اعمال حاكميتي يا تصدي، امكان جبران خسارات ناشي از آن و مبناي اين جبران خسارت مورد بررسي قرار گيرد. در انتهاي اين تحقيق مشخص خواهد كه اعمال سياست هاي مالي، در صورتي كه به موجب تقصير سنگين دولت و يا مامورين آن باشد، مي تواند موجب مسئوليت مدني دولت باشد. مبناي اين جبران خسارت بر اساس نظريه عمومي تقصير استوار است. لذا در مصاديق تقصير سنگين دولت در زمينه سياست هاي مالي همچون اعمال سياست هاي مالي بدون در نظر گرفتن وضعيت كشور و يا عدم اعمال نظارت بر اجراي سياست ها و مواردي از اين دست، نبايد هزينه هاي اينچنين اقدامات دولت را بر افراد بار نمود.

The basis for this compensation is based on the general theory of fault. Therefore, in the examples of the government's heavy blame for financial policies, such as the application of financial policies, regardless of the state of the country or the lack of monitoring of the implementation of policies and the like, should not cost the government such actions.
