يكي از موضوعات مهم در زمينه امنيت غذايي حفظ حقوق شهروندان غيرنظامي و ساير گروه‌هاي جمعيتي در طول مخاصمات مسلحانه بين‌المللي و غير‌ بين‌ المللي است. كنوانسيون‌هاي چهارگانه ژنو بر اين امر صحه گذاشته و اين حقوق به عنوان يكي از مباني حقوق بشر در نسل دوم حقوق بشر مي‌بايست توسط طرفين درگير در مخاصمه رعايت شود. متاسفانه درطول جنگ يمن، اصل تفكيك نسبت به اين موضوع با نقض فاحش از سوي طرفين درگيري به ويژه ائتلاف به رهبري عربستان واقع شده است. در مقاله پيش رو بر آن هستيم تا اين موضوع را از بعد رسيدگي حقوقي و كيفري نسبت به حق امينت غذايي در قالب جنايات مقامات نظامي و دولتي مورد بررسي قرار دهيم. بدون شك اين موضوع از بعد توسعه پايدار انساني نيز اهميت دارد. بر پايه قطعنامه 2216 و نيز ماده 51 منشور ملل متحد، موضوع مي‌تواند در محاكم بين‌المللي مورد پيگرد قرار گيرد. با همراهي جامعه جهاني، شوراي امنيت و مجمع عمومي مي‌توان از طريق صدور قطعنامه و ايجاد صلاحيت جديد نسبت به جرايم عليه امنيت غذايي به صورت تكميلي و ضمني، نقض حق بر غذا در درگيري‌هاي يمن را قابل پيگري دانست.
