حكم ساخت بناي مشترك در منا از نگاه مذاهب اسلامي

Ruling over construction a joint building in Mena for the view point of Islamic denominations

منا سرزميني است كه اعمال مهمي از حج تمتع در آن انجام مي‌گيرد. محدود بودن اين سرزمين و ازدياد روزافزون حاجياني كه مي‌خواهند اعمال خاص منا را در در اين مكان انجام دهند، ازدحامي عظيم پديد مي‌آورد كه منشأ مشكلات فراواني براي حجاج مي‌شود. اما آيا مي‌توان با ساخت بناي مشترك در اين اراضي، مشكل ازدحام را حل كرد؟ آيا ساخت چنين بنايي جايز است؟ هيئت كبار علماي عربستان سعودي، با تمسك به ادله‌اي چون سد ذرائع و سيره رسول الله و روايتي از عايشه، به حرمت ساخت هرگونه بنايي، حتي بناي مشترك در اين اراضي، فتوا داده است؛ اما با بررسي ادله ايشان، معلوم مي‌شود كه هيچ يك از اين ادله توان اثبات حكم حرمت براي ساخت بناي مشترك در منا را ندارد و در مقابل، مقتضاي برائت اصليه و عمومات قاعده حل و عموميت حق ارتفاق و سيره ثابت مسلمين از زمان رسول الله و روايتي از امام كاظم(ع)، ادله‌هايي قطعي است كه جواز ساخت بناي مشترك در اراضي منا را اثبات مي‌كند.

Mena is a land where many major Hajj rituals are done. Due to the increasing number of pilgrims who would like to practice the Mena-specific rituals there and not being a vast land, huge crowd gather there and cause many problems for pilgrims (Hajji). But, can we construct a joint in this land to solve the problem? Is such a construction permissible? The Saudi Arabian council of senior scholars, resorting to the clues such as preventing any corruptive deeds and Al-Sirah (prophetic biography) as well as a narration from Ayesha, has declared the construction of any building even a joint one in this land prohibited. Yet, the analysis of the clues shows that none of these clues can prove the prohibition of the joint building construction in Mena. In return, the nature of continuity of presumption of innocence as well as generalities of principle of the right to possess things the permissibility or prohibition of which is doubted, generality of easement right, the fixed tradition of Muslims since the time of the Messenger of Allah (PBUH) and a narration from Imam Kazim (as.) are strong reasons for permissibility of constructing a joint building in the land of Mena.
