چكيده فارسي :
انجماد انسان يا كرايونيك يكي از مسائل نوپديد در علم پزشكي محسوب مي گردد كه نخستين بار در سال 1960 مطرح شد. در اين روش با قراردادن دماي بدن انسان در منفي 196 درجه اقدام به حفاظت از بدن مي شود تا در آينده با پيشرفت علم پزشكي، اقدام به احياي اشخاص منجمد گردد. اين روش اميدي براي حيات دوباره بيماران لاعلاج ايجاد كرده است. علي رغم سكوت قوانين موضوعه، موسسات مختلفي در چند كشور به ويژه در آمريكا، روسيه و استراليا اقدام به انجماد انسان ها مي نمايند. موسسه آلكور در آمريكا از شناخته شده ترين موسسات مي باشد. در رويه قضايي برخي نظام هاي حقوقي مانند انگليس و آمريكا نيز نشانه هايي از توجه به اين موضوع ملاحظه مي شود. مساله اصلي در خصوص انجماد انسان، وضعيت حقوقي اشخاص منجمدشده از حيث زنده يا مرده بودن است. تبيين آثار حقوقي انجماد انسان، مستلزم تشخيص وضعيت حيات اشخاص منجمد شده است. در اين مقاله بر مبناي اثبات زنده محسوب گرديدن اشخاص منجمد، مهم ترين آثار حقوقي انجماد انسان از جمله وضعيت رابطه زوجيت شخص منجمد و وضعيت اموال و قراردادهاي جاري او مورد مطالعه و ارزيابي قرار گرفته است. با توجه به عدم شناسايي اين مفهوم در حقوق ايران، براي معرفي و تبيين آثار آن ناگزير از استفاده از تجارب كشورهايي هستيم كه در عمل از اين نهاد استفاده مي كنند. در اين مقاله به روش توصيفي تحليلي و با توجه به حقوق آمريكا به لحاظ پيشگام بودن در اين عرصه، مفهوم انجماد و برخي آثار حقوقي آن تبيين شده است.

Cryonics is one of the emerging issues in medical science, which was
first introduced in the 1960. In this way, by placing the human body
temperature at a negative 196 degrees, the body is protected and with the
advancement of medical science in the future, it will attempt to revive it.
This method has created hope for life for the sick. Despite the silence of the
laws in this regard, various institutions in several countries, especially in the
United States, Russia and Australia, have begun to freeze human beings. The
Alcor Institute in America is one of the most recognized institutions. There
are also signs of attention to this issue in the precedent of some legal systems
such as the United Kingdom and the United States. The main issue regarding
cryonics is the legal status of frozen persons from the perspective of life or
death. In this article, with the assumption of the live of frozen individuals,
the most important legal effects of cryonics, including the status of the
marriage, property and current contracts, have been studied. Given the lack
of recognition of this concept in Iranian law, in order to introduce and
explain its effects we have to use the experiences of the countries that use it
practically. In this article cryonics and some legal effects of it is studied with
descriptive-analytic method and with regard to American law as a pioneer in
this field.
