جايگاه و نقش مباني و قواعد فقهي در تعيين حقوق سياسي زنان در نظام جمهوري اسلامي ايران

The Role of Jurisprudential Fundamentals and Rules in Determining Women's Political Rights in the Islamic Republic of Iran

به دليل ابتناي حقوق اساسي جمهوري اسلامي ايران بر مباني فقهي شريعت اسلام، فهم و تفسير بايسته حقوق سياسي- اجتماعي زنان نيازمند شناخت مباني فقهي آن است. از دلايلي كه درباره گستره حقوق سياسي زنان بدان استناد مي­شود، قواعد فقهي است. پژوهش حاضر با هدف بررسي جايگاه و نقش مباني و قواعد فقهي در تعيين حقوق سياسي زنان در نظام جمهوري اسلامي ايران به­روش توصيفي و تحليلي انجام شد. با توجه به تعدد مباني و قواعد فقهي قابل استناد در اين موضوع، اين پژوهش ضمن بررسي تأثير هر كدام از قواعد فقهي در فهم و تفسير اصول حقوقي، بدين پرسش پاسخ داد كه قاعده مبنايي در بهره ­مندي زنان از حقوق سياسي در موارد ابهام يا سكوت ادله شرعي چيست و جايگاه و نقش هر يك از اين قواعد كلي در تحليل اصول قانوني چگونه است؟ بسياري از نظريات فقهي با تكيه بر اصل عدم ولايت، به تضييق دامنه حقوق سياسي زنان در تصدي مناصب ولايي حكم داده ­اند. درحالي­كه با توجه به اصول و قواعدي مثل اباحه، مساوات، اشتراك و عدالت كه در اصول مختلف قانون اساسي، سياست گذاري­ ها و اسناد بالادستي نظام جمهوري اسلامي ايران بدان اشاره و تأكيد شده است، در نظام جمهوري اسلامي ايران مبناي توسعه­ اي در حقوق سياسي زنان در نظر گرفته شده است.

In order to have a proper understanding and explanation of women's social-political rights, it is needed to know its jurisprudential fundamentals, because Iranian constitutional law is based on Islamic jurisprudential fundamentals. Jurisprudential rules are the reasons cited for the scope of women's political rights. The present study was conducted with the aim of investigating the role of jurisprudential fundamentals and rules in determining women's political rights in the Islamic Republic of Iran and with the help of a descriptiveanalytical method. Due to the numerous citable jurisprudential fundamentals and rules, this study tried to examine the effect of each jurisprudential rule on understanding and explaining legal principles and respond to these questions: What is a basic rule with which women can have political rights when there are not any religious reasons in that case? What is the role of each of these general rules in analyzing legal principles? Based on the principle of non-guardianship, many jurisprudential theories rule on reducing the scope of women's political rights in assuming guardianship-related positions; while, according to some principles, such as permission, equality, sharing, and justice, mentioned in the Islamic Republic of Iran's Constitution, policies, and high priority documents, the extension of scope of women's political rights are emphasized.
