ساختار و صلاحيت مراجع شبه قضايي حقوق آب ايران

A Thinking on the structure and jurisdiction of Administrative Tribunals in Iran water law system

رويكرد نظام حقوقي اعم از قوانين، مقررات، رويه ها و آراي محاكم به منابع آب، در چگونگي مديريت مصرف و صيانت از اين ماده حياتي، بسيار تعيين كننده است و براساس موضوعاتي همچون لزوم تامين امنيت آب و حفظ منافع عمومي، حكومت قواعد حقوق عمومي بر منابع آب، امري ضروري است. در نظام حقوقي ايران حسب تصريح اصل چهل و پنجم قانون اساسي، رودخانه ها و ساير آب هاي عمومي از مصاديق مهم انفال و ثروت هاي عمومي قلمداد مي شوند. بر اين اساس، نهادهاي اداري ملي و محلي همچون وزارت نيرو و شركت هاي آب منطقه اي و مراجعي شبه قضايي تحت عناوين «كميسيون رسيدگي به صدور پروانه ها» و «كميسيون رسيدگي به امور آب هاي زيرزميني» در امر مديريت عمومي منابع آب، مسئوليت قانوني يافته اند. مقاله حاضر ضمن تحليل صلاحيت هاي قانوني نهادهاي يادشده، نظام حل اختلاف ميان آنها و شهروندان را نيز محل مطالعه قرار داده و پيشنهادهايي در راستاي صيانت مطلوب از منافع عمومي ارائه داده است.

The legal system approach including rules, regulations and judgmental procedure to water sources has a significant role in the management of water consumption and with due attention to matters such as security of water and protection of public interests , sovereignty of public law rules on water sources is necessary. The constitution of Islamic Republic of Iran has accepted the water sources as a public wealth, so some public organizations at national or local jurisdiction like water ministry, water companies and Administrative Tribunals have legal responsibility in the public management of water sources. This paper with analysis the jurisdiction of this institutions , has studied the ways of dissolving the disputes between them and citizens and finally has proposed amendments for protection of public interests.
